Soluções Responsáveis is the product brand used in Portugal. eOmistaja is the product brand used in Finland.

The smart identification service is offered under the Devolva Me name in Portugal and may also be referred to internationally as the Return Me service.

Scope

These Terms of Service apply to consumer purchases made through this online store and to the use of smart tags and related digital services supplied with the products.

Separate written agreements may apply to business customers, integrations, white-label services or other customised services.

Products and availability

Product names, descriptions, characteristics, prices and availability are displayed in the store.

We make reasonable efforts to ensure that product information is accurate. Minor variations in colour or appearance may occur because of photography, manufacturing differences or display settings.

Products are subject to availability. If we cannot fulfil an order, we will notify you and refund any amount already paid for the unavailable product.

Prices and taxes

Prices are displayed in euros and include applicable value-added tax unless clearly stated otherwise.

Delivery charges and other applicable costs are shown at checkout before the order is submitted.

We may change prices for future orders. A price change does not affect an order that has already been accepted.

Ordering and formation of the contract

Products are selected by adding them to the shopping cart.

Before submitting the order, you can review and correct the products, quantities, prices, delivery address and delivery charges.

By placing an order, you confirm that:

the information you have provided is accurate;

you have the legal capacity to place the order;

you accept these Terms of Service; and

you accept the policies presented or linked at checkout.

After the order is placed, an order confirmation is sent to the email address provided during checkout.

A contract is formed when we accept the order and send the order confirmation, subject to applicable mandatory consumer law.

Payment

Available payment methods are displayed at checkout and may vary depending on the market, delivery address and payment provider.

Payments are processed through secure encrypted connections by Shopify and the selected payment provider. We do not receive complete payment card details.

If payment is declined or cannot be confirmed, the order may not be accepted or dispatched.

Delivery and returns

Delivery is governed by our Shipping Policy.

Products offered to customers are fulfilled from Portugal warehouse. 

Withdrawal, returns, refunds, cancellations and defective products are governed by our Refund Policy.

Nothing in these terms limits mandatory consumer rights under applicable Portuguese, Finnish or European Union law.

The Devolva Me and Return Me service

Certain products include access to a digital smart identification service.

The service may include:

registration and management of smart tags;

QR- or NFC-based identification;

found-item notifications;

privacy-friendly communication between an owner and finder;

customer account functionality; and

other features described on the product page.

A smart tag must normally be registered before all service features become available. Product-specific notification allowances, technologies and limitations are described on the relevant product page.

Nature of the service

The purpose of the service is to increase the likelihood that a lost item can be identified and returned.

The service provides a communication channel between the registered owner and a person who finds an item. We:

do not take possession of lost items;

do not collect, store, transport or deliver lost items;

do not verify legal ownership of an item;

do not act as an intermediary in ownership disputes;

cannot require a finder to return an item; and

do not guarantee that an item will be found or returned.

A finder’s decision to contact the owner or return an item is voluntary.

User responsibilities

You are responsible for:

providing accurate and current registration information;

keeping account credentials confidential;

preventing unauthorised account access;

keeping information connected to a tag current;

ensuring that content associated with a tag is accurate and lawful; and

notifying us of suspected unauthorised use.

You may request deletion of your account by contacting us. Some information may be retained where required for legal, accounting, fraud-prevention or dispute-resolution purposes.

Acceptable use

The store, smart tags and digital service must not be used:

for unlawful or fraudulent purposes;

to impersonate another person;

to provide false or misleading information;

to harass or threaten another person;

to distribute malicious software;

to interfere with the security or operation of the service;

for unlawful surveillance or unauthorised tracking; or

in a manner that infringes another person’s rights.

We may restrict or terminate access where reasonably necessary to prevent misuse, protect users or maintain service security.

Service availability

We aim to keep the digital service available, but continuous and uninterrupted availability cannot be guaranteed.

Temporary interruptions may result from maintenance, security updates, telecommunications failures, third-party providers, force majeure or circumstances outside our reasonable control.

We may improve, modify or discontinue individual service features where reasonably necessary. This does not remove mandatory rights relating to products or services already purchased.

Intellectual property

The store, digital service, software, designs, trademarks and related content are owned by or licensed to FLASHIRRESISTÍVEL, UNIPESSOAL LDA.

Purchasing a smart tag gives you the right to use the product and associated service under these terms. It does not transfer ownership of the underlying software, technology, trademarks or other intellectual property.

Liability

Nothing in these terms excludes or limits liability or consumer rights that cannot legally be excluded or limited.

To the extent permitted by law, we are not responsible for:

the loss, theft, destruction or delayed return of an item;

a finder’s actions or failure to act;

inaccurate information supplied by another user;

third-party websites or services;

interruptions caused by external networks or providers; or

indirect losses that were not reasonably foreseeable when the contract was formed.

Complaints and disputes

Please contact info@solucoesresponsaveis.pt first so that we can attempt to resolve your complaint.

Consumers may also use competent consumer protection authorities and alternative dispute resolution services available under applicable law.

These terms do not prevent a consumer from bringing a claim before a court that has jurisdiction under mandatory consumer law.

Changes to these terms

We may update these terms for future purchases or future use of the service. The version applicable to an order is the version presented when the order is placed.
